declined and that's why he didn't receive the paperwork.  When asked why, he was told it was an internal computer technicality
and glitch in their system because they took too long, and that they simply would re-input the information, which they again
did with him on the phone, and he was approved, once again - and again waiting for the paperwork.

Growing tired of waiting, he demanded to speak with their attorney and was told they did not know who that was.   Finally, after
nearly four months since the episode began, ASC identified the attorney and instructed the borrower to resolve it directly with
them.   He immediately called the attorney and explained what had occurred.  The attorney said they had just gotten his file,
had not looked at it yet, but would call ASC and hasten ASC's preparing the paperwork for him to sign at their office " within
the next few days, if possible, and resolve the matter."   Instead, that attorney that day ordered their staff to prepare and file a foreclosure action and had it served on him several days later, then refused to take or return any phone calls or respond to correspondence whatsoever after that first, and only, conversation.  The foreclosure named a lender having nothing to do with
his loan.  

The borrower filed suit.
                                                                                                                                                                                                                                        The suit not only names the servicer AMERICAS SERVICING COMPANY, but Wells Fargo which does business using that
name, it names a host of others, including the first attorney which filed the foreclosure action and then refused to discuss the
matter or give any information or even figures on the loan after they filed.  The borrower rescinded the loan after Americas
Servicing  Company sent him a new payments schedule that he didn't agree to in which they demanded huge fees and he make
payments of over $3,000 a month on his under $90,000 loan which they decided to keep at 11%, even though his old loan would
have had a substantially lower interest rate with adjustable rates declining.  He's also asking for substantial damages which
includes destruction of his career, substantial reduction of his property value through the use of unregulated predatory lender
scams by the lending industry and foreclosure operations, which he says includes fraudulent claims of fees, who owns the loans,
and is a ruse to dramatically increase income for loan servicers and wind up acquiring properties with substantial equities in
them, such as in his case, where Americas Servicing Company was making maybe between $25 and $30 a month, and are now
attempting to make as much as $100,000 or more on him through their scheme, which he says in his lawsuit constitutes
racketeering under both State and Federal law.  He says their patterns and practices are clearly established and intentional,
and are not a result of ineptness or disorganization.

In a lawsuit filed in Florida in 2008, America's Servicing Company is accused of having induced a borrower into defaulting on his nearly
11% Ajustable Rate Mortgage by promising him he would receive a 6.200% fixed rate mortgage to replace it if he allowed his $85,000 first
mortgage  ( which he had since 2004 without any 30 day lates ), to become 30 days delinquent as a condition of his receiving the new loan
- and the much more favorable terms (his original rate for the first several years had been nearly half of the 11%.

He further was told that if he made any payment to them whatsoever before the first new scheduled payment was established by them, that
they would withdraw their offer and he would not get the new, and much more attractive, lower rate.  Upon questioning, he was told that no
derogatory information would appear on his credit report and his account would continue to be shown as PAID AS AGREED since he would
be paying according to the new terms they were establishing and obeying their instructions, so he would not be defaulting on his current loan.

No paperwork ever arrived.

Finally he was told, after having been told that his loan was approved and he would receive the paperwork, that the new loan had since been

After ASC's original attorney just sat on the case, Americas Servicing Company and Wells Fargo have now hired a litigating defense law firm from West Palm Beach in November 2008, who filed a Motion to Dismiss the complaint against them in December which the parties have now stipulated to re-pleading the matters and conducting discovery and further Motions.  The law firm is Carlton Fields, which has offices in Miami, Orlando, West Palm Beach, St. Petersburg, Tallahassee, Tampa, as well as Atlanta.

The borrower has discovered that America's Servicing Company is not licensed to do business in Florida where the property is located.  The defense attorney says Americas Servicing Company needs no license and is regulated by the Office of the Comptroller of the Currency.  The OCC says they have never heard of Americas Servicing Company and have no record of them, nor have they certified them to do business.
