On our journey to locate the physical whereabouts and legal existence of Americas Servicing Company, the Wells Fargo shareholders office said that ASC is independent of Wells Fargo and that they were "not aware of any relationship [between them], but had a phone number for them and could transfer us to them if we liked, because 'we [the shareholders office] have the ability to transfer callers "anywhere, to anyone".' We were transferred...to a recording. After going through a lengthy recorded questionnaire, "Yolanda" with ASC came on the line, identified herself as being in South Carolina, said that ASC was "a subsidiary of Wells Fargo Home Mortgage", and that ASC's corporate address was PO Box 10328, Des Moines Iowa. They had no street address. The Iowa Secretary of States' office said that Wells Fargo Home Mortgage "withdrew from Iowa on June 9, 2004," and then made a rather strange and startling revelation. "If you are a corporation registered in Iowa, you do not need to inform the State of Iowa of any DBA you use in Iowa." Apparently, any scamster can form a corporation, register IT in Iowa, and then proceed to do business under any other names it wants and NO ONE will find out who they are....or where, at least not from the state of Iowa. THAT MAY NOT BE ENTIRELY TRUE, and it is not true that Iowa definitely doesn't know anything about Americas Servicing Company. They DO. And so does the Office of the Comptroller of the Currency. If Wells Fargo doesn't want you to know about Americas Servicing Company, they are getting help from state and federal agencies.
Doing a search just for the word 'AMERICAS' in the Iowa Secretary of States office, - it did lead to more information than Wells Fargo was willing to let you - and even its' employees know, and that's: the name AMERICAS SERVICING COMPANY is, in fact, 'registered' somewhere on paper- although rather curiously and more appropriately called - being obscurely and circuitously listed, or intentionally buried, in Iowa, at

IS THAT RECORDING INTENDED TO MISLEAD BORROWERS INTO BELIEVING THAT WELLS FARGO IS, ON IT'S OWN INITIATIVE, GOING TO IDENTIFY EVERYONE WHO IS AND MAY BE IN THE FUTURE FACING 'CHALLENGES' AND THUS ATTEMPTING TO DISSUADE CUSTOMERS FROM EVEN TRYING TO CONTACT THEM ?

I used to work for ASC (Wells Fargo) in the Loss Mit department. I worked for them for about 8 months. In that time I watched and heard many stories of how people are losing their homes. In all honesty most of the time the people that you are talking to don't care if you lose your home or not. Most of the time the phone reps are making fun of the caller or calling them names under their voice. People with asc loans lose their house because the company itself could care less about the people they claim to be serving. The company itself is nothing more than a front for Wells Fargo, the call centres and offices are all in Wells Fargo buildings and the people work for WF and are paid by WF. Another thing about the company is how badly organized it is. You can talk to one person an hour and get a totally different story than the last one told you. So all in all if you have a mortgage with ASC best of luck to you, you will need it more than ever before.
ASC is trying to drive me to foreclosure. I've been trying for the past nine months to get this company to give me a loan modification. When I finally got an agreement, it expired before it was mailed to me. Not only do they have the worst cust. serv., but they bounce you around like a tennis ball b/w the many departments and never get a straight answer. They give you different answers to the same issue but neither departments communicate with each other, therefore always hitting a dead end. This company loves to confuse people! They are the worst.
This Company is a mortgage servicing company for Wells Fargo. They are using their position to take advantage of homeowners. Homeowners that contact them for help are lead down a road of shams. People that own homes are not crooks; they are hard working people that have gotten into a dilemma. The problem with America's Servicing Company or (Wells Fargo) is that people for them have become numbers on a balance sheet. These banks go on the news and to the US government and ask for help. But went help is asked of them they offer their back hand. There was a time went people knew the bank manager and they would work out a plan to get things in order. But at last these days are gone. What we have left is a system that has failed us and will lead to more problems for the banks.

My story: I'm disabled and divorced. I was hospitilized and during this time they took all the steps and received a judgment against me. I wasn't even given an opportunity to present the truth. I didn't even know they were in Court ! They told me all was being worked out and their errors fixed. I can't afford to fight them. When they closed my credit score was 740. Now my credit score has dropped over 200 points, and I can't get help . WFHM has a profitable scam going, and they close their eyes to the human beings they don't deserve to have as their clients. I promise you, WFHM, if you do not cease and desist in your fraudulent actions against me (and millions of other shell-shocked home owners), and if you do not make restitution, I will continually create and search for ways to make my name one you hear on a daily basis. I've submitted to this board before. I want to let you all knowsomething that is riveting. I was too going to get away from ASC so I started a re-fi. Trouble was they had my credit so screwed up that Iwas getting taken by this new finance broker called: TopDot Mortgage a division of Premium Capital Funding LLC). Well they were totally trying to take advantage from me by ripping me off on this re-fi for rolling in $18, 000 into my mortgage with would have left me with hardly any equity in my home. They lied to me twice, I bounced the offer and they came back with a offer that was $4, 000.00 lower than the first one and then lied to me again. So I decided to call ASC and have a talk with them. I actually got a human on the phone who was very very nice, her name was Tammy I believe. Anyway, I started mentioning to her that I was planning on a re-fi and asked should I call Wells Fargo their parent. She said, sure you should, so she gave the number to their loan division. I called them and got this great person named (Christopher)who I explained my situation, re-fi woes and disasters in dealing with ASC in general and how they tried to take my home 2 years ago this June, and he was very sympathetic to all. He asked me for my original loan numbers with ASC, looked at my history and within 1 1/2 hours called me back and approved me for a re-fi (recast) of my loan directly with them, with all my Taxes, Insurance etc.. rolled in. And it was only going to cost me less than a percent to do this deal with them. The weight was off my shoulders, I tell you !!!
I'm awaiting my new loan docs and paid them in advance for the home inspection which someone is to call me this week. I'll keep you all posted on the outcome of this. But do yourself a favor and call Wells Fargo directly and put yourself behind in dealing with ASC for evermore. I can't believe I didn't think of this sooner. Wells Fargo knows there are issues with ASC being the servicing company to some loans out there. From what I'm hearing Wells is going to be done with that division soon. I hope for all of you that is true. Keep your head up!!!
In October of 2006, I fell behind on my mortgage payments and contactedASC. They sent me a package to fill out for a repayment plan for the 2 months I missed. I never heard from them! I called every month and got the same answer, your file is with the "Negotiator" (is that Arnold Schwartzneager?) and that there are a lot of people in front of me, and to be patient. Also they told me not to pay anything until I hear from the "Negotiator". Yesterday, I received a call from guess who...the"Negotiator"! February 21, 2007. That was 5 months later ! WOW! We decided to refinance to get rid of this company and when I called to get a payoff, a very rude customer service rep told me "YOU ARE IN FORECLOSURE"! WOW!! This must be how they make money by telling people to not pay their mortgages and stall you till they file FORECLOSURE papers (which by the way, I never received any notice ). After speaking with the "FORECLOSURE ATTORNEY" I cannot get a payoff amount for 7-10days, so we have to wait to pay off this loan and I'm sure we'll have to pay interest on those 7-10 days!!! Something is wrong here and consumers need to be aware! The problem is... no one financed through this company, this company bought out mortgages from other GOOD companies. WE ARE ALL VICTIMS AND SHOULD FILE A CLASS-ACTION LAW SUIT AGAINST ASC AND WELLS FARGO!!! I have sent two complaints to the BBB, ASC in Iowa and ASC in North Carolina ( loss mitigation dept ),
and also a complaint to my Attorney General. If anyone out there knows what else I need to do, please reply. Aren't there any laws against these practices? It sure feels like fraud to me!
Wow! Didn’t know there were that many out there having the same issue with ASC. We, just like the rest of you, started our loan modification well in advance so that when it came time our modification request should have been handled. Of course when we started calling about the progress we were informed that all we sent in was out dated, since they sat on it for 3 months.
We went ahead and sent everything in again and in the meantime we were told NOT to make a payment if we couldn't make the new payment. I was told that late charges would not incur nor would it be reported to the credit bureaus. I have since then re-faxed our information 2 more times and was told they were expediting our request and would soon be assigned to someone. Calling again and again... We were also told to make some kind of payment and we were never going to be assigned to anyone. Well to no avail I still tried one more time after waiting again for the time line to pass only to find out that our file was closed. I believe that if I could walk into the office my concern and want tohave a house over our 2 and 4 year old children might actually sinki nto someone’s brain. We have not had a single mark, late, or default on our loan and apparently means nothing. Maybe we should all get together for a class action suit!!! |
